Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the http://www.walmyr.com website (the "Site") and the WASSPWeb online scoring application (the "Service") operated by Walmyr Publishing Company, which is in turn owned and operated by H Plus Enterprises, LLC ("us", "we", or "our").

Your access to and use of the Site or Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Site or Service.

By accessing or using the Site or Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Termination

We may terminate or suspend access to our Site or Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Products

Our Products include various Walmyr Assessment Scales and training materials ("Content") and are available for purchase. Assessment scales are one-use items and are generally purchased in pads of 50 or in groups of 10. They may not be photocopied or otherwise reproduced. These scales were designed and validated only for native English speakers residing in North America, South Africa, Australia, New Zealand, and the United Kingdom. Because there is no validity data for their use in other populations, we cannot grant permission for their use in other contexts. We retain the right to pursue legal action against any who infringe upon our copyright (see Copyright).

It is incumbent upon the user to educate him- or herself on the proper use of assessment tools in his or her practice or research. While the Walmyr Assessment Scale Scoring Manual (WASSM) does provide some guidance, it does not take the place of specialized education from an accredited college or university. By using our products, you warrant that you are sufficiently educated and credentialed in the administration of such tools and the interpretation of results.

Subscriptions

Our Service allows you to score the Walmyr Assessment Scales ("Content") you have purchased. There is no limit to the number of scales you can score during your active subscription period, but this does not affect, reduce, or limit the copyright of our products in any way. We retain the right to pursue legal action against any who infringe upon our copyright (see Copyright).

Our Site or Service may contain links to third-party web sites or services that are not owned or controlled by Walmyr Publishing Company.

Walmyr Publishing Company has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Walmyr Publishing Company or its parent, H Plus Enterprises, LLC, shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide, by email to those on our mailing list, at least 30 days‘ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
